Course content

This session looks at the various aspects of termination from both an employer and employee perspective with a significant focus on minimising claims for both unfair and unlawful termination.

Topics include the small business exemption, the types of claims that can be made by employees, what might constitute a breach, the various remedies that can be applied and the penalties that can be enforced.

Session objectives

Participants will be able to ascertain the sources of legislation and their obligations in relation to the different types of termination, record keeping and notice obligations on termination, entitlements at termination, as well as ramifications for unfair, unlawful and general protections claims.

At the end of this information session participants will have a better understanding of:

  • what termination laws really mean in practical terms to an organisation
  • rights and responsibilities of employers and employees in relation to the various types of termination that occur
  • key concepts in relation to procedural fairness
  • differences between unfair and unlawful termination
  • critical issues associated with effecting the termination of an employee
  • consequences of effecting an unfair or unlawful termination
  • risks and consequences.
